Dubai: A Dubai court has ordered compensation of Dh350,000 (Rs78 lakh) to Budhan Bhagat, a native of Bihar, who was injured in an accident at work.
On November 4, 2016, he fell from the seventh floor to the sixth floor while working at a construction company in Rashidiya, Dubai. The court found that the accident was caused by the negligence of the company's security and safety supervisor and engineers and the company's failure to provide safety systems. The court then fined both the construction company and the two of them Dh10,000 and released them.
Bhagat suffered serious injuries in this accident. Therefore, he approached Salam Pappinissery, a legal representative and social activist in the UAE, to seek compensation. Later, on his instructions, he filed a case in the Dubai Civil Court. A case was registered against the Security and Safety Supervisor, the engineer and the company responsible for the accident, seeking compensation. Bhagat's lawyer approached the court with strong documents, including forensic medical reports collected from the Medico-Legal Department of the Dubai Court.
When the case reached the court, the opposing party argued that the accident occurred due to Bhagat's negligence, that he used to provide instructions and facilities to the workers, and that the case should be dismissed. However, the opposing party's arguments could not stand up to the documents and arguments submitted by Bhagat's lawyer. The court found that the fault was on the opposing party's side and that it was the company's responsibility to ensure all safety measures at the scene of the incident, and therefore Bhagat was entitled to compensation.
Later, based on the forensic medical report submitted by Bhagat's lawyer and the injuries that satisfied the court, the court ordered the opposing party to pay Bhagat two hundred and fifty thousand dirhams. However, Bhagat's lawyer, showing that this verdict was not satisfactory, approached the Court of Appeal and submitted a memorandum containing medical reports, showing that the compensation was not adequate considering the accident suffered by Bhagat and that more compensation should be awarded.
After reviewing the arguments and documents, the Court of Appeal found that the amount awarded by the civil court was not adequate and ordered the opposing party to pay Bhagat three hundred and fifty thousand dirhams and 5 percent legal interest until it was fully paid.
