A Jordanian national has been awarded 500,000 dirhams (Rs. 1.10 crore) in compensation for a car accident in Sharjah.

A Dubai court has ordered a compensation of 5 lakh dirhams (1 crore 3 lakh Indian rupees) to Abdul Rahman (20), a Jordanian national who was injured in a car accident. The court order in Abdul Rahman's favor has come after a year-long legal battle.

On August 7, 2020, in Sharjah, the driver of the vehicle in which Abdul Rahman was driving rammed into another parked vehicle due to the driver's error. All four people in the vehicle, including the driver, sustained serious injuries.

Subsequently, since Abdul Rahman, who was seriously injured in the car accident, was under 21 years of age and could not file a case directly, the child's father Ibrahim approached YAB LEGAL SERVICES - CEO and social activist Salam Pappinissery for compensation. Later, through his intervention, a case was registered against a leading insurance company in the UAE by submitting medical reports and police reports before the Insurance Authority. In that case, the Insurance Authority asked the insurance company to pay 500,000 dirhams in compensation.

However, the insurance company filed a civil case in the Dubai Court, claiming that the fault was with the driver of the vehicle and that according to the documents submitted, Abdul Rahman did not suffer any significant injuries, and that the amount awarded was excessive and that it should be reduced. When the case reached the court, Abdul Rahman's lawyer submitted a reply memorandum with strong documents, including medical reports.

The insurance company's arguments could not stand up to the documents and arguments submitted by Abdul Rahman's lawyer in the court. The court found that according to the medical report, Abdul Rahman had suffered serious injuries and that if the vehicle was fully insured, it was the insurance company's responsibility to pay compensation to the persons in it, regardless of who was at fault, and that no one intentionally put his body in danger, so the amount awarded by the Insurance Authority should be paid. Later, the insurance company went to the Court of Appeal and the Supreme Court with the same argument, but it could not stand up to the reply memorandum containing sufficient documents submitted by Abdur Rahman's lawyer. It was found that the medical report submitted at the time was sufficient to assess the injuries and compensation and the insurance company's argument was completely rejected.

Based on the medical report submitted by Abdur Rahman's lawyer and the injuries submitted to the court, the Supreme Court ordered Abdur Rahman to be paid 507278 UAE dirhams (i.e. 1 crore 10 lakh Indian rupees) and 5 percent of its legal value.
