Dubai: After a long legal battle, the Dubai Court of Appeal has rejected the appeal of the insurance company and increased the compensation amount awarded by the lower court to 9 lakh dirhams from 2 lakh dirhams. The accident in question occurred on January 1, 2016. Yusuf Kalan (47), a native of Kalpakanchery, Malappuram, was seriously injured when he was hit by a car with a Fujairah registration. A case was filed at the Fujairah and Dibba Traffic Police Stations, and Yusuf and the car driver who were involved in the accident were found guilty and fined. Following the accident, Yusuf Kalan, who was seriously injured, was admitted to the hospitals in Dhaid and Fujairah by social workers and sent home for further treatment after emergency surgery.
The complainant's relatives and social workers approached some lawyers to seek compensation for the car accident, but they gave up, saying that the huge treatment costs would have to be paid at Dibba and Fujairah hospitals, and that compensation would not be available because of Yusuf's fault. Then, they approached Salam Pappinissery, CEO of Yab Legal Services. Through him, a case was filed against the insurance company, the vehicle owner, and the driver.
The lawyers appearing for the insurance company questioned the court's jurisdiction to consider the case and argued that the cause of the accident was not the driver's fault, but that the injured complainant had crossed the road carelessly. However, the court ordered the complainant to be paid two hundred thousand dirhams and court costs as compensation. The complainant's lawyer, citing the shortcomings and errors of the lower court judgments in the appeal, requested the court to pay one million dirhams as compensation, considering the seriousness of the accident caused by the complainant. The insurance company appeared before the Court of Appeal and argued against these arguments, arguing that there were shortcomings in the laws applied and the interpretations of the lower court. It also requested the court to annul the lower court's judgment and dismiss the plaintiff's appeal, as the incident did not fall within the jurisdiction of this court. After hearing the arguments of both parties, the court found the 200,000 dirhams awarded by the lower court to be inadequate and increased the compensation amount to 900,000 dirhams.
