Dubai: A Dubai court has ordered Amirullah (29), a Pakistani national who was injured in a road accident, to pay 529,945 dirhams (37.6 million Pakistani rupees) in compensation through the intervention of Salam Pappinissery, CEO of YAB legal services, social activist and well-known legal representative in the UAE. The court's order in favor of Amirullah comes after a year and a half of legal battles.
On August 22, 2019, Amirullah was crossing the road on his bicycle at Al Rashid Intersection in Dubai when he was hit by another vehicle. The court found that the accident was due to the negligence of both of them and the Traffic Criminal Court subsequently fined them both 1,000 dirhams.
Then, Ameerullah, who had sustained serious injuries in the car accident, approached Salam Pappinissery, CEO of YAB LEGAL SERVICES, to get compensation. Later, through his intervention, a case was registered against a leading insurance company in the UAE and the driver of the vehicle by submitting medical reports and police reports before the Insurance Authority. In that case, the Insurance Authority asked the insurance company to pay only 25,000 dirhams in compensation.
However, according to the documents submitted, Ameerullah had not received compensation for the injuries he suffered and Ameerullah's lawyer filed a civil case in the Dubai Court, demanding compensation for mental, physical and financial injuries. When the case reached the court, the lawyer of the opposing insurance company filed a reply memorandum, arguing that Ameerullah was at fault and therefore he was not entitled to compensation. The court, after observing the arguments and counter arguments, upheld the verdict of the Insurance Authority.
Later, Ameerullah's lawyer approached the Court of Appeal, presenting a new medical report and the responsibility of the vehicle that hit Ameerullah. The Court of Appeal considered that the amount awarded by the Authority was not sufficient to compensate Ameerullah for the mental, physical and financial injuries he suffered.
Based on the medical report submitted by Ameerullah's lawyer and the injuries he had presented to the court, the Court of Appeal ordered Ameerullah to be paid 529,945 dirhams (37.6 million Pakistani rupees).
