ABU DHABI: The Insurance Dispute Settlement Court has ordered a compensation of AED 120,000 (approximately 40 lakh Bangladeshi Taka) to Moshaed Hormus Ali, a Bangladeshi national who sustained severe injuries in a traffic accident in Mussafah Industrial Area, Abu Dhabi, on November 8, 2023.

The Incident:

On November 8, 2023, Moshaed Hormus Ali was walking along a service road near the footpath in the Industrial Area when he was struck from behind by a speeding bus. The investigation concluded that the accident was caused by the negligence, carelessness, and traffic violations of the Pakistani national bus driver.

Moshaed was rushed to Burjeel Medical City with serious injuries to his head and ear. The medical forensic report confirmed that the brain trauma resulted in a permanent disability of 80% hearing loss in his left ear.

Legal Proceedings:

The Criminal Court found the bus driver guilty of negligence and issued a fine of AED 3,000.

Following the severe injuries, Moshaed Hormus Ali's relatives approached Salam Pappinissery, CEO of Yab Legal Services, for compensation. Salam Pappinissery took up the case and filed a compensation claim against the bus's insurance company, submitting all necessary documentation, including the medical forensic report and the criminal case report.

The Insurance Dispute Settlement Court ruled that the bus's insurance company must pay Moshaed Hormus Ali AED 120,000 in compensation. Additionally, the court ordered the payment of a 5% interest, AED 3,850 for medical expenses, and AED 500 for advocate fees.
