Compensation of 350,000 dirhams to a Pakistani national who was injured in a car accident

On Monday, October 14, 2019, at 6:20 p.m., two cars collided in Al Aweer, under the jurisdiction of Dubai Rashidiya Police Station, resulting in serious injuries to Asadullah, a passenger in the car.

The accident occurred when the driver of the oncoming car carelessly swerved. Asadullah's right femur was fractured and his nerves were damaged. The court found that the accident was caused by the Emirati's negligence, and the Traffic Criminal Court fined the driver Dh2,000 and released him.

Subsequently, Asadullah, who was seriously injured in the car accident, approached Salam Pappinissery, CEO of YAB LEGAL SERVICES and a social activist, to seek compensation. Later, through his intervention, a case was registered against a leading insurance company in the UAE and the driver of the vehicle by submitting medical reports and police reports before the Insurance Authority for compensation. Since the fault was on the part of the driver of the vehicle and Asadullah was seriously injured according to the medical report, the Insurance Authority asked the insurance company to pay 350,000 dirhams (two crore seventy million Pakistani rupees) in that case.

Although the insurance company argued that he did not suffer serious injuries and was not entitled to the compensation sought, it was found that the medical report submitted at the time was sufficient to assess the injuries and compensation and the insurance company's argument was completely rejected. The fact that the defendant did not go to the civil case and appeal further increases the relevance of this case and the arguments.
