Compensation of 400,000 dirhams to a Tamil Nadu native , who was injured in a car accident.

A Dubai court has ordered compensation of 400,000 dirhams (90 lakh Indian rupees) to Tamil Nadu native Tamimul Ansari, who was injured in a car accident, through the intervention of YAB Legal Services CEO Salam Pappinissery.

On December 22, 2021, a vehicle driven by a Gujarati national while intoxicated and violating traffic laws crashed into a bike driven by Tamimul Ansari within the limits of the Jebel Ali Police Station in Dubai. The court found that the accident was due to the negligence of the Gujarati national and the Traffic Criminal Court fined the driver 25,000 dirhams and suspended his driving license for 6 months and released him.

Subsequently, Tamimul Ansari, who suffered serious injuries in the car accident, approached YAB LEGAL SERVICES - CEO Salam Pappinisseri to seek compensation. Later, through his intervention, a case was registered against a leading insurance company in the UAE and the driver of the vehicle by submitting medical reports and police reports before the Insurance Authority. In that case, the Insurance Authority asked the insurance company to pay 300,000 dirhams in compensation.

However, the insurance company filed a civil case in the Dubai Court, arguing that according to the documents submitted, Tamimul Ansari did not suffer any significant injuries, that the amount awarded was excessive, and that the medical report should be reviewed again and reduced. At the same time, Tamimul Ansari's lawyer also filed a civil case in the Dubai Court, claiming that the amount awarded was not sufficient for compensation and that a higher amount should be awarded as compensation based on the severity of the injuries.

When the case reached the court, the insurance company's arguments could not stand up to the documents and arguments submitted by Tamimul Ansari's lawyer to the court. The court found that the fault was on the part of the driver of the vehicle and that according to the medical report, Tamimul Ansari had suffered serious injuries, so the amount awarded by the Insurance Authority should be increased from 300,000 dirhams to 400,000 dirhams.

Later, the insurance company approached the appellate court with the same argument, but it could not withstand the reply memorandum containing sufficient documents submitted by Tamimul Ansari's lawyer. It found that the medical report submitted at the time was sufficient to assess the injuries and compensation, and accordingly, the civil court's judgment was modified and the insurance company's argument was completely rejected.
