Dubai: An entrepreneur from Thiruvananthapuram had given a security check to take a personal loan from the bank. He tried to withdraw the security check without any notice and after it bounced, he filed a complaint and obtained a verdict to return the huge amount.
The loan amount was seven lakh forty thousand dirhams, of which he had returned six lakh twenty five thousand dirhams. The remaining amount was only one lakh fourteen thousand dirhams. However, the bank's complaint stated that two lakh twenty four thousand dirhams was to be received. Accordingly, the court ruled in favor of the bank in the check execution case. Due to that verdict, he had to face a travel ban and other restrictions.
The Malayali, who was in crisis, approached YAB Legal Services CEO Salam Pappinissery to avoid the case in his name and get the facility to pay only the exact amount to be returned. Through his intervention, he submitted evidence to the Sharjah court and filed a complaint. The memorandum stated that the bank had not reached the judgment to recover the money through a fair means, that the amount mentioned in the judgment was too much, and that the judgment in favor of the bank should be canceled. After examining the documents and evidence provided, the court found that the method adopted by the bank was not correct, that the guarantee check should not be bounced and executed directly, and that the outstanding amount should be recovered only through a civil case, and after giving warnings, the judgment in favor of the bank was canceled. Due to this, the Thiruvananthapuram native was spared the additional liability of one lakh ten thousand dirhams (approximately 25 lakh Indian rupees) and difficulties such as travel restrictions. Now, he had the facility to pay the remaining amount slowly.
