DUBAI: The Dubai Court has ordered an insurance company to pay AED 750,000 (approx. 5.7 Crore PKR) in compensation to a Pakistani national, Sohail Munir Munir Hussain, who was left with catastrophic injuries following a head-on collision. The landmark judgment was secured through the legal efforts of Salam Pappinisseri, CEO of YAB Legal Services.

The Incident

The tragic accident occurred on March 12, 2023, at 3:30 AM near Dubai Investment Park 1. A Nigerian student, driving under the influence of alcohol, entered Sheikh Zayed Road from the wrong direction at high speed, crashing into the vehicle driven by Sohail. Dubai Police confirmed the driver's intoxication via a breathalyzer test at the scene.

Life-Altering Injuries and Medical Struggle

Sohail was rushed to NMC Hospital in critical condition, where he underwent multiple emergency surgeries. The impact of the crash left him with permanent, debilitating damage to several vital organs. He suffered a Grade 2 injury to the pancreas and severe trauma to both kidneys, resulting in a significant and permanent loss of organ function.

The damage extended to his respiratory and digestive systems, fundamentally changing his quality of life. Due to the severity of his internal injuries, doctors had to perform a tracheostomy—creating a opening in his neck—as he can no longer breathe naturally through his nose or mouth. Additionally, a perforation in his small intestine necessitated the insertion of a feeding tube (Jejunostomy) directly into his gut, as he is unable to consume food normally.

Legal Battle and Final Verdict

While the criminal court sentenced the offending driver to jail time and a license suspension, the civil battle for compensation was fought by YAB Legal Services. The legal team presented comprehensive forensic medical reports to prove the 100% loss of natural function in Sohail’s respiratory and digestive systems, alongside 50% disability in his pancreas and kidneys.

The court ultimately ordered the insurance company to pay AED 750,000, plus 5% annual interest until the payment is fully settled. Despite the insurance company’s attempts to challenge the amount in the Court of Appeals and the Supreme Court, the original verdict was upheld, ensuring justice for the victim.
