Dubai Bike Accident: Pakistani National Awarded 34 Lakh Pakistani Rupees Compensation


Dubai: A Pakistani national, Wajid Muzaffar Khan Haji, who was injured in a motorcycle accident in Dubai, has been awarded AED 40,000 in compensation and AED 4,100 for medical expenses by the court. The legal intervention of Salam Pappinissery, CEO of Yab Legal Services, was crucial in securing this verdict. This amount is equivalent to approximately 34 Lakh Pakistani Rupees.
The incident occurred on May 12, 2024. Wajid, a delivery staff member for a company, was riding his motorcycle in the Business Bay area on Burj Khalifa Street when he lost control and fell due to a sudden change in direction while attempting to exit a roundabout. He sustained injuries to his right shoulder and other body parts. He was immediately admitted to International Modern Hospital by ambulance.
In his statement to the police regarding the accident, Wajid stated that a vehicle coming from the right side hit him from behind while he was trying to exit the roundabout, causing him to lose control and fall. However, an examination of the case documents, including the accident blueprint, police report, and medical report, revealed that the accident was caused by his lack of due care and attention while driving on a public road. Wajid was fined AED 1000 in this criminal case.
Many had told Wajid that he would not receive any compensation as the police had found him at fault. It was in this situation that he approached Salam Pappinissery, CEO of Yab Legal Services. Salam Pappinissery took on the case, and the lawyers under his leadership initiated legal proceedings to secure compensation.
A case was registered with the Insurance Authority against Wajid's motorcycle insurance company, along with supporting documents including a copy of the accident report, the criminal case verdict, forensic medical report, and payment receipts.
Although the insurance company argued that Wajid was at fault and therefore not entitled to compensation, the court, considering the precise rebuttal memorandum submitted, ruled that Wajid should be paid AED 40,000 as compensation and AED 4,100 for medical expenses.
