Dubai Court Orders AED 40,000 Compensation for Pakistani National Injured in Road Accident


Dubai, UAE – The Dubai Courts have ordered a compensation of AED 40,000 (approximately 31 Lakh Pakistan Rupees) to Ali Nawaz Muhammad Riaz, a Pakistani national who sustained serious injuries in a road accident in Dubai. This significant verdict was achieved through the legal intervention of Salam Pappinissery, CEO of YAB Legal Services.
The incident occurred on the evening of Tuesday, September 26, 2023, in the Jafiliya area of Dubai, within the jurisdiction of the Bur Dubai Police Station. The accident involved a Nissan Yaris car driven by an Iranian national and a Honda motorcycle operated by Ali Nawaz Muhammad Riaz. Investigations revealed that the collision happened when the car dangerously overtook another vehicle and swerved to change lanes, leading to the impact with the motorcycle.
Following the accident, the injured Ali Nawaz Muhammad Riaz was immediately transported to Rashid Hospital for treatment. Police examination of the accident scene concluded that both parties were at fault. Consequently, the Dubai Criminal Court ruled that both drivers were culpable, imposing a fine of AED 1,000 on each.
Ali Nawaz Muhammad Riaz suffered significant injuries, including trauma to his left upper limb, resulting in a fractured humerus. This injury necessitated surgical intervention with an open reduction and internal fixation using a metal plate and screws. While his condition has stabilized, he experienced residual issues such as an irregular humeral surface, localized pain, and restricted movement in his shoulder joint, along with general weakness in his arm. These permanent disabilities led to a 20% impairment of his left upper limb.
Seeking compensation for his injuries, Ali Nawaz Muhammad Riaz engaged YAB Legal Services. Under the guidance of Salam Pappinissery, a compensation claim was filed, supported by a copy of the accident report, a detailed forensic medical report, and payment receipts. The case was brought against the insurance companies of both vehicles, which happened to be the same entity.
The Dubai Court, after reviewing the submitted evidence, awarded AED 40,000 in compensation. The court also decreed an additional 5% interest per annum on the compensation amount, effective from the date of the verdict until the full payment is made.
