Dubai: In a significant development, Hamza Saleem Mohammed Saleem, who sustained serious injuries in a car accident on April 18, 2022, has been awarded AED 400,000 (approximately PKR 30 million) in compensation by a Dubai court. Mr. Salam Pappinissery, CEO of Yab Legal Services, played a crucial role in securing the ruling through his relentless efforts and intervention.
The accident occurred on Emirates Road when a vehicle driven by a Jordanian national, traveling from Sharjah towards Jebel Ali, collided with the car in front, driven by a Pakistani national. The impact caused Hamza Saleem's vehicle to swerve to the right and hit another car traveling in the right lane of the road.
Hamza Saleem suffered severe injuries in the collision, while his sister, Tamkeen Saleem Mohammed, who was also in the car, sustained minor injuries. Both were immediately rushed to Rashid Hospital for treatment.
The Jordanian national, who was found at fault for not maintaining a safe distance, faced a criminal case. The Dubai Traffic Criminal Court imposed a fine of AED 3,000 for reckless driving and endangering others' safety, after which he was released.
However, Hamza Saleem's injuries were far more severe, particularly a traumatic brain injury (TBI). Medical reports confirmed he also exhibited symptoms of Post-Traumatic Stress Disorder (PTSD), memory loss, and depression. The report indicated a 40% disability in brain function and stated that the head injury could affect the vision in both eyes. Despite the severe repercussions, Hamza had not received any compensation. This prompted his relatives to approach Salam Pappinissery, CEO of Yab Legal Services.
Mr. Salam Pappinissery took on the case and initiated legal proceedings to secure compensation. The initial claim was filed with the Insurance Authority, supported by necessary documents including medical reports and the criminal case judgment. The insurance company of the at-fault vehicle was named as the respondent. After reviewing the documents, the Insurance Authority ruled for a compensation of AED 300,000.
Deeming this amount insufficient, Hamza's advocate filed a case with the Dubai Civil Court. A strong memorandum, accompanied by comprehensive medical reports detailing the severity of the injuries, was submitted to the court. After hearing the arguments, the court reviewed the case and increased the compensation amount to AED 400,000 (equivalent to approximately PKR 30 million).
