Compensation of 4.5 lakh dirhams to a Pakistani national who was injured in a car accident.

A Dubai court has ordered the compensation of 4.5 lakh dirhams (three crore thirty-six lakh Pakistani rupees) to Noor Shahjahan Abat Khan, a Pakistani national who was injured in a car accident in Sharjah, through the intervention of YAB LEGAL SERVICES CEO Salam Pappinissery.

On January 30, 2022, while loading a broken-down car into a recovery vehicle within the limits of Sharjah Al Wasit Police Station, the car driver's negligence caused the car to skid to the left, injuring the driver of the recovery vehicle, Noor Shahjahan.

The Sharjah Criminal Court found the driver guilty and ordered him to pay a fine of 3,000 dirhams, after finding that the driver of the car did not follow the rules when loading the car into the recovery vehicle. However, Noor Shahjahan, who suffered serious injuries to his head, face, and chest, did not receive any compensation. That is how the case was approached by Salam Pappinissery, CEO of YAB LEGAL SERVICES, a leading law firm in the UAE, and legal proceedings were initiated under his leadership to obtain compensation.

Noor Shahjahan's advocate registered the case with the Insurance Authority, making the insurance company of the recovery vehicle the opposing party, along with the necessary documents such as the medical report, criminal case judgment, and memorandum. After examining the documents submitted, the court ruled that the insurance company of the recovery vehicle should pay Noor Shahjahan 4 lakh dirhams as compensation. However, realizing that Noor Shahjahan's injuries were serious and that this amount would not be enough, Noor Shahjahan's lawyer registered a case in the Dubai Civil Court demanding an increase in the compensation amount. He submitted strong evidence for this. At the same time, the insurance company of the recovery vehicle had also registered a case, claiming that the compensation amount awarded by the Insurance Authority was too high and that it should be reduced. The Dubai Civil Court, which examined both cases in detail, increased the compensation amount to four and a half lakhs and rejected the insurance company's arguments. Later, the insurance company approached the Court of Appeal demanding a reduction in the award amount, but the case was dismissed as it could not withstand Noor Shahjahan's arguments.
