Compensation of 5 lakh dirhams to Bangladeshi national, who was injured in a car accident.

The court has ordered compensation of 1.5 million Bangladeshi dhakas (5 lakh dirhams) to Bangladeshi national Mohammed Ghulam Farooq, who was injured in a car accident in Dubai, through the intervention of YAB LEGAL SERVICES CEO Salam Pappinissery.

On August 21, 2019, while crossing a pocket road onto the highway within the limits of Rashidiya Police Station, the car was carelessly speeding and hit Ghulam Farooq, who was walking on the side of the road. He suffered serious head and other injuries due to the impact and was immediately admitted to the hospital.

The Dubai Criminal Court, which found that the Bangladeshi driver’s negligence was the cause of the accident, found the accused guilty and ordered him to pay a fine of 2000 dirhams. However, although the driver paid the fine and was cleared of the criminal case, Ghulam Farooq did not receive any compensation. That is how YAB LEGAL SERVICES CEO Salam Pappinissery approached. After examining the details of the case, he took up the case and initiated legal proceedings to obtain compensation.

He registered a case with the Insurance Authority, including the insurance company of the vehicle that caused the accident as the opposing party, and submitted the necessary documents such as the medical report, criminal case judgment, memorandum, etc. After examining the documents, the court ordered the insurance company to pay 5 lakh dirhams as compensation to Ghulam Farooq. However, the lawyer for the insurance company filed a case in the Dubai Civil Court, claiming that the amount awarded by the court was too high and therefore requested that it be reduced. But in the civil case, Ghulam Farooq's advocate submitted a reply memorandum along with proper documents, so the case was dismissed. Later, an appeal case was registered by the insurance company, but the appeal case was also dismissed. Thus, Ghulam Farooq was awarded 5 lakh dirhams.
