Indian Expat Awarded AED 100,000 Compensation Following Severe Road Accident

Ras Al Khaimah: In the road accident that happened in UAE’s Ras Al Khaimah, the court ordered to give one lakh Dirham (approximately 25 lakh Indian Rupees) compensation to a Malayali youth. court ordered the compensation for Niyad Nazeer, who is a Sales Supervisor in Sharjah.

The accident occurred on the morning of May 20, 2024, on Kadra Street, RAK, while Niyad was traveling toward the Shawka area in his Nissan Sunny. A vehicle driven by a Pakistani national attempted to overtake another car in a strictly "no-overtaking" zone.

As the oncoming vehicle swerved onto the off-road shoulder to avoid a collision, Niyad—in a split-second attempt to save himself—steered in the same direction. This resulted in a high-impact, head-on collision on the dirt track, leaving Niyad with severe leg injuries.

Initially, the Criminal Court found the Pakistani driver guilty of the traffic violation and imposed a fine of AED 5,000. Following this, Niyad sought the assistance of YAB Legal Services to pursue civil damages. A compensation case was subsequently filed before the Insurance Dispute Resolution Committee against the offending driver's insurance provider.

A forensic medical examination confirmed that Niyad suffered a 30% permanent disability in his leg due to the accident. Based on this report and the evidence presented, the court awarded him AED 100,000.

Although the insurance company’s legal team filed an appeal to reduce the compensation amount, the Appellate Court dismissed the appeal and upheld the primary judgment, after YAB Legal Services submitted a comprehensive memorandum defending the original verdict.
