Indian National Injured in Sharjah Road Accident Awarded AED 40,000 Compensation

SHARJAH: The UAE Insurance Dispute Resolution Court has ruled that AED 40,000 (approximately INR 9.6 Lakh) must be paid as compensation to Shaikh Rana Shiakul Shaikh, an Indian national who sustained serious injuries in a road accident in the Al Qarayen 1 area of Sharjah.

The incident occurred on Saturday, August 10, 2024. Shaikh Rana, a delivery company bike driver, was involved in the accident while his motorcycle was completely parked off the road in Al Qarayen 1. A car driven by an Emirati national, approaching from the right, collided with the motorcycle while attempting to turn left. The police report concluded that the accident was caused by the driver's lack of attention and negligence.

Shaikh Rana suffered serious injuries to his leg and thigh and was initially admitted to Al Qasimi Hospital before being transferred to Fujairah Hospital.

The Emirati driver responsible for the accident received a community service sentence in the criminal case, requiring him to memorize one part (Juz') of the Holy Quran within two months.

Following the incident, Shaikh Rana’s relatives approached Salam Pappinissery, CEO of YAB Legal Services. Under his supervision, a compensation case was filed against the insurance company of the at-fault vehicle.

Considering all submitted evidence, including the medical certificate and police report, the court ruled that the insurance company must pay AED 40,000 as compensation, AED 4,107 for medical expenses, and 5% interest on the compensation amount, effective from the date of the verdict until full payment is made.

The insurance company appealed this verdict to the Court of Appeal. However, the appellate court rejected the insurance company's appeal after Shaikh Rana's advocates submitted a robust counter-memorandum clearly detailing the severity of the injury and the legal merits of the case.
