Judgment in favor of Palakkad woman in case against private school


Sharjah: A Palakkad native has been awarded a favorable verdict by the court in a civil case in which she was awarded a private school. Naseema Ismail, a native of Palakkad, who is the owner of Suriya Stationery in Sharjah, has been ordered to pay one lakh seventeen thousand nine hundred forty-four dirhams (twenty-two lakh rupees) in a civil case filed in the Sharjah court. Naseema filed the case against a private school in Sharjah. She had filed the case in the Sharjah civil court through Salam Pappinissery, CEO of Yab Legal Services, claiming that she was entitled to the specified amount for the stationery provided.
The lawyer appearing for the school argued that Suriya Stationery had distributed the bags to the children and that they were of good quality, and therefore, despite the fact that the company had been asked to take them back, the school had not taken them back and had instead given them back as a bribe. However, Naseema's lawyer, who was disappointed with this argument, presented the LPO, invoices, documents showing that the goods were delivered, checks showing that a part of the amount had been received, etc. in the court.
However, the originals of all the invoices were not presented. The court was also aware that the LPO and invoice were originals. Naseema's lawyer also drew the court's attention to the Supreme Court's ruling that copies of documents that are believed to be originals can also be accepted as evidence.
The court rejected the school's argument and accepted the documents and arguments submitted by Naseema's lawyer and ordered her to pay Rs. 22 lakh and court costs under Article 133.
Naseema, who had closed down her establishment due to financial crisis and went back to her home country, approached many lawyers, but as she did not get a satisfactory response, she approached Salam and had the power of attorney attested by Abdul Nassar Kombath, a notary lawyer in Palakkad, and handed him over.
