Mumbai Native's Family Gets AED 300,000 (₹72 Lakh) Compensation After Death While Undergoing Treatment for Road Accident Injuries


Dubai: The family of a Mumbai native who sustained serious injuries in a road accident and later succumbed to them while undergoing treatment in Dubai has received a compensation of AED 300,000 (approximately ₹72 Lakh Indian Rupees) after a legal battle. Justice was served to the family of Naseem Ahammad Ainul Haque, a resident of Golibar Santacruz, Mumbai, through the intervention of Yab Legal Services.
The accident occurred on June 12, 2021, on Dubai’s Al Khail Street in the direction heading towards Sharjah. A Bentley car driven by an Emirati national rear-ended the motorcycle being ridden by Naseem Ahammad Ainul Haque. The accident was caused by the car driver failing to maintain a safe distance.
Naseem Ahammad Ainul Haque suffered severe head injuries and was admitted to the Trauma Department of Rashid Hospital. Due to a cerebral contusion, he fell into a coma and later passed away while under treatment. In connection with the incident, the Emirati citizen who caused the accident was fined AED 3,000 as per the criminal case verdict.
Turnaround in the Legal Fight:
Initially, Naseem’s relatives had approached a law firm in Abu Dhabi and granted them a Power of Attorney to pursue the compensation case. However, due to a lack of proper follow-up and insufficient documentation submitted by that office, the initial court ruling granted only AED 100,000 in compensation.
Subsequently, Naseem’s relatives approached Salam Pappinisseri, CEO of Yab Legal Services. After taking over the case, the firm registered a compensation claim at the Dubai Civil Court, submitting essential documents, including the forensic report and the criminal case report. Considering the documents, the court ordered the insurance company of the vehicle that caused the accident to pay AED 300,000 as compensation.
The insurance company appealed this verdict in the Appeal Court, but due to a strong memorandum in response submitted by Yab Legal Services, the appeal was dismissed. The court upheld the Civil Court’s decision, mandating the payment of the full compensation amount.
