Pakistani National Awarded AED 110,000 in Compensation After Dubai Road Accident


DUBAI: The Insurance Dispute Settlement Committee in Dubai has ordered an insurance company to pay AED 110,000 (approximately 83 Lakh Pakistani Rupees) in compensation to Ihsan Allah Fazal Karim, a Pakistani delivery rider who sustained severe permanent injuries in a traffic accident in Al Quoz.
The accident occurred on July 7, 2024, in Al Quoz Industrial Area 3. Ihsan Allah was performing his duties as a delivery rider when a BMW, driven by an Egyptian national, made a sudden and negligent lane deviation. To avoid the car, Ihsan Allah lost control of his motorcycle, which resulted in the bike overturning and sliding into a Dubai Taxi.
The Egyptian driver was subsequently found guilty of reckless driving and failing to ensure the road was clear, resulting in a fine of AED 2,000 imposed by the Criminal Court.
The impact left Ihsan Allah with grave injuries to his spine and legs. He was rushed to Medeor Hospital, where he underwent complex surgery to stabilize his spine using metallic fixations. Forensic medical reports later confirmed that the accident resulted in permanent disabilities, specifically a 30% disability in his spinal functions and a 15% disability in his left leg.
Faced with mounting medical bills and a loss of livelihood, Ihsan Allah’s relatives sought the assistance of Salam Pappinissery, CEO of YAB Legal Services. The legal team filed a civil claim against the insurance provider of the Egyptian driver, submitting comprehensive evidence including the criminal verdict and forensic reports detailing the severity of the permanent disabilities.
After reviewing the strong arguments and medical documentation, the court ruled in favor of Ihsan Allah. The insurance company was ordered to pay a primary compensation of AED 110,000 for physical and moral damages. Additionally, the court directed the insurer to pay AED 4,100 for medical expenses and AED 500 in legal fees.
