A Dubai court has ordered Ram Babu Kumar, who was injured in a collision between vehicles belonging to Bihar nationals, to pay 44 lakh rupees (200,000 dirhams) in compensation, including court costs, through the intervention of YAB Legal Services CEO Salam Pappinissery.


Dubai: On November 19, 2021, another Bihari national was caught in a traffic accident in Al Qusais, Dubai, when he was driving recklessly and without maintaining a safe distance, which resulted in him hitting the vehicle in front of him, which then rammed into the vehicles behind him one after the other. Ram Babu was in the vehicle driven by the driver who was responsible for the accident. Ram Babu and three other passengers in the vehicle sustained serious injuries. All four were immediately admitted to Al Dhaid Hospital.
The Bihari national who was driving the vehicle was found guilty by the court in a criminal case and was released after being fined Dh3,000 and sentenced to one month in prison. On this occasion, a case was filed in the Dubai Court against the vehicle's insurance company for compensation. Ram Babu approached Salam Pappinissery, CEO of YAB LEGAL SERVICES in the UAE, to take legal action for this.
Ram Babu's lawyer argued in court that the insurance company that insured the vehicle should pay compensation, as Ram Babu had sustained injuries all over his body and that the driver's negligence was the cause of the serious injuries. After hearing the arguments, the court ordered the insurance company to pay 200,000 dirhams in compensation.
Against this, the insurance company approached the Court of Appeal and argued that the injuries were not serious and that such a high amount was excessive, and that the insurance company's lawyer should only award compensation based on the injuries after examining the medical reports and documents.
However, the arguments of the insurance company's lawyer could not stand up in the face of the medical reports and documents submitted by Ram Babu's lawyer.
The court, after considering the arguments of both parties, examined the medical report issued by the UAE Medico-Legal Department and the records of the medical expenses, and found that the first instance court had awarded the same 200,000 dirhams, dismissing the insurance company's appeal and imposing legal fees on them.
