Ras Al Khaimah Traffic Accident: Family of Filipina National Awarded AED 400,000 Compensation


Ras Al Khaimah: The Ras Al Khaimah Court has ordered a total compensation of AED 400,000 (approximately 66 Lakh Philippine Pesos) to be paid to the family of Arlene Guan Silvestre, a Philippine national who tragically lost her life in a road accident.
The fatal accident occurred on the night of May 23, 2024. Arlene Guan Silvestre and another passenger, Baby Alin, were traveling home in a vehicle driven by a Bangladeshi national. The driver jumped a red light near the Airport Road, leading to a violent collision with a truck and another car. Both Arlene and Baby Alin succumbed to their injuries.
The Criminal Court found the driver guilty of negligence and traffic violations. The court imposed a fine of AED 5,000 on the driver and ordered him to pay AED 200,000 as Diya money (Blood Money) to the legal heirs of each deceased victim. Furthermore, as per legal requirements for accidental death, the court ordered the driver to fast for two consecutive months.
Under the professional guidance of Salam Pappinissery, CEO of Yab Legal Services, the legal team initiated a "Tarikāt" case to secure the designated blood money for the grieving family. To ensure a seamless process, the team meticulously prepared and submitted all essential documentation, including Legal Heir Certificates, Special Power of Attorney, and Breadwinner Certificates. While the team successfully secured the initial AED 200,000 in Diya money, they determined that this amount was insufficient to fully cover the family's extensive emotional and financial loss. Consequently, they escalated the matter by approaching the Insurance Authority and filing a civil lawsuit against the insurance company of the offending vehicle, ultimately securing the additional compensation the family deserved.
The Civil Court ruled in favor of the family, granting an additional AED 200,000 as compensation over and above the Blood Money. With this final verdict, the total compensation for Arlene’s family reached AED 400,000.
