Sharjah court avoids deportation of Kasaragod native for driving while license suspended


Sharjah: The Sharjah Appeal Court has ruled that a Malayali youth who was fined 5,000 dirhams and sentenced to deportation for driving over the limit while his driving license and vehicle were suspended for drunk driving should pay only the fine instead of the deportation sentence. The Kasaragod native got relief through legal services provided by Salam Pappinissery, CEO of Yab Legal Services.
He was driving on the road again on 01-03-2023 despite the court order suspending his driving license and vehicle for drunk driving. In the session held on 11/7/2023, the first instance court sentenced the accused to one month in prison, a fine of five thousand dirhams, deportation from the country after serving the sentence, and payment of the costs of the case. The public prosecution argued in the court that this act was a crime that harmed society because it disregarded the law of the country and posed a danger to the people. Since it posed a threat to the public, the court ordered the accused to be deported and a fine of 5000 dirhams under Section 126 of the amended Federal Penal Code.
With this, the relatives of the accused who was in prison approached Yab Legal Services. After examining the details of the case, the advocate took up the case and soon released him on bail. The advocate then approached the Sharjah Appeal Court and argued that he had gone to visit a friend for an important matter that could not be delayed, that the crime he was tried for did not cause any hardship to the community or the people, that his family, consisting of his wife and children, had been living in the UAE for 19 years, two of whom were born and raised here, and that it was unthinkable for him to leave this country under any circumstances. The appeal court, after examining the memorandum submitted in detail, commuted the sentence and quashed the deportation proceedings.
