Umm Al Quwain Car Accident: Bangladeshi National Injured Awarded AED 120,000 in Compensation


The court has ordered a compensation of one hundred and twenty thousand Dirhams (AED 120,000), approximately 39 lakh Bangladeshi Taka, to Muhammad Shariful Islam, a Bangladeshi national injured in a car accident in Umm Al Quwain.
Details of the Incident:
The incident occurred on July 26, 2024. Shariful Islam and his brother were walking along the side of the road in the Al Ramlah area of Umm Al Quwain when a Mercedes-Benz car driven by an Emirati national hit them from behind. The driver who caused the accident fled the scene without stopping.
Subsequent investigation revealed that the driver was under the influence of drugs. The Traffic Criminal Court fined the driver AED 4,500. The driver admitted in court that he was at fault and drove without due attention.
Serious Injuries and Legal Proceedings:
Shariful Islam sustained serious injuries to his collarbone and right arm, resulting in a permanent disability. Unable to secure compensation, Shariful Islam's relatives approached Salam Pappinissery, CEO of Yab Legal Services.
After taking on the case, Yab Legal Services filed a civil compensation claim in the Insurance Compensation Court against the insurance company of the Emirati citizen's vehicle. The claim included sufficient evidence such as the Forensic Report, Criminal Case Report, and Medical Records.
The Court Verdict:
Considering the documents and evidence, the court ordered the payment of one hundred and twenty thousand Dirhams (AED 120,000) as compensation to Muhammad Shariful Islam. Additionally, the court ordered that an annual interest of 5% be paid on the total amount from the date of the verdict until full settlement, along with an additional AED 4,100 for medical fees. The timely legal intervention by Salam Pappinissery was crucial in securing justice for the expatriate victim.
